These Terms of Service ("Terms") govern your access to and use of Magic Jigsaw, including our games, websites, applications, and related services (collectively, the "Service") provided by Ludus Altus Limited ("Ludus Altus," "we," "our," or "us"), with an office located at 3001 Brighton Blvd Ste 513, Denver, CO 80216, United States.

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must discontinue your use of the Service.

1. Eligibility

You must be at least 13 years of age to access or use the Service, or any higher minimum age required under applicable law in your jurisdiction.

If you are under the age of majority in your jurisdiction, your parent or legal guardian must review and agree to these Terms on your behalf where required by applicable law.

You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.

2. Account Registration and Security

Certain features of the Service may allow or require you to create an account.

Where an account is required, you agree to provide accurate, complete, and current information.

You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account.

You must promptly notify Ludus Altus if you believe that your account has been accessed or used without authorization.

We reserve the right to suspend or terminate accounts that contain false, misleading, or unauthorized information or that are used in violation of these Terms.

3. Limited License

Subject to your compliance with these Terms, Ludus Altus grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service solely for your personal, non-commercial entertainment purposes.

You may not, except as expressly permitted by applicable law or with our prior written permission:

Copy, reproduce, distribute, or publicly display the Service;
Modify, adapt, translate, or create derivative works based on the Service;
Reverse engineer, decompile, disassemble, or attempt to discover the source code of the Service;
Circumvent or interfere with security features or technical restrictions;
Use the Service for unauthorized commercial purposes; or
Use automated systems or software to access or interact with the Service in an unauthorized manner.

4. User Conduct

You agree that you will not:

Use cheats, hacks, bots, automation software, exploits, or unauthorized third-party tools;
Interfere with the operation, security, or integrity of the Service;
Attempt to gain unauthorized access to accounts, systems, servers, or networks;
Exploit bugs, errors, or vulnerabilities for an unauthorized purpose;
Upload or transmit unlawful, abusive, defamatory, threatening, obscene, infringing, or otherwise objectionable content;
Engage in fraud, phishing, spam, or unauthorized commercial activities through the Service;
Impersonate another person or entity;
Use the Service in violation of applicable laws or regulations; or
Encourage or assist others in engaging in any prohibited activity.

Ludus Altus reserves the right to determine, in its reasonable discretion, whether conduct violates these Terms and to take appropriate action.

5. Virtual Items and In-App Purchases

The Service may, where applicable, offer virtual currency, virtual items, additional content, features, or other digital products ("Virtual Items").

Virtual Items are licensed to you for use within the Service and are not sold or transferred to you as property.

Virtual Items have no monetary value outside the Service and may not be exchanged for cash or other monetary value unless expressly permitted by us.

You may not sell, transfer, trade, or otherwise dispose of Virtual Items outside the Service.

Purchases may be processed by Apple App Store, Google Play, or other authorized distribution or payment platforms.

Except where required by applicable law or the applicable platform's policies, purchases are final and non-refundable.

Ludus Altus may modify, replace, suspend, or discontinue Virtual Items or other digital content where reasonably necessary for the operation or development of the Service.

Nothing in this section limits any rights you may have under applicable consumer protection laws.

6. Subscriptions

Where the Service offers subscription-based features:

Subscriptions may automatically renew unless canceled before the applicable renewal date.
You authorize the applicable platform provider to charge your selected payment method for recurring subscription fees.
Subscription prices, billing periods, renewal terms, and cancellation procedures will be presented to you before purchase where required by applicable law.

Subscriptions purchased through Apple App Store or Google Play are generally managed through the applicable platform.

You may cancel a subscription according to the cancellation procedures provided by the applicable platform or Service.

If no subscription service is offered, this section does not apply.

7. Refunds and Purchases

Purchases made through third-party platforms may be subject to the refund policies of those platforms.

For purchases made through:

Apple App Store, refund requests may need to be submitted through Apple;
Google Play, refund requests may need to be submitted through Google; or
Another authorized platform, the applicable platform's refund procedures may apply.

Where permitted by applicable law, Ludus Altus may deny refund requests resulting from fraud, abuse, unauthorized transactions, or violations of these Terms.

Nothing in these Terms is intended to exclude or restrict any mandatory refund or consumer rights provided by applicable law.

8. User Content

Certain features of the Service may allow you to submit or share usernames, messages, screenshots, feedback, or other materials ("User Content").

You retain ownership of your User Content. However, by submitting User Content through the Service, you grant Ludus Altus a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, display, distribute, and otherwise process such User Content solely as reasonably necessary to operate, maintain, improve, and promote the Service.

You represent and warrant that:

You own or otherwise have the necessary rights to submit the User Content;
Your User Content does not violate applicable laws or third-party rights; and
Your User Content does not contain unlawful, harmful, or prohibited material.

We may remove, restrict, or disable access to User Content that we reasonably believe violates these Terms or applicable law.

9. Intellectual Property

All intellectual property rights in and to the Service, including Magic Jigsaw, software, game mechanics, artwork, graphics, animations, music, audio, logos, trademarks, text, designs, and other content, are owned by or licensed to Ludus Altus.

Except for the limited license expressly granted under these Terms, nothing in these Terms grants you any ownership, intellectual property, or other proprietary rights in the Service.

You may not use the name, logo, trademarks, or other branding of Ludus Altus or Magic Jigsaw without our prior written permission.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, disclose, retain, and protect personal information.

By using the Service, you acknowledge that your information may be processed as described in our Privacy Policy.

11. Updates and Changes to the Service

The Service may be updated, modified, or improved from time to time.

We may:

Add, modify, or remove features;
Release updates, patches, or new versions;
Modify game content or functionality; or
Temporarily suspend certain features for maintenance, security, or technical reasons.

Where permitted by applicable law, we are not required to maintain every feature or content element indefinitely.

You may need to install updates to continue using certain portions of the Service.

12. Suspension and Termination

We may suspend, restrict, or terminate your access to all or part of the Service if:

You materially violate these Terms;
You engage in unlawful, fraudulent, abusive, or harmful conduct;

Your use of the Service creates a security or operational risk;

We are required to do so by law or a competent authority; or

It is reasonably necessary to protect the Service, our users, or our legitimate interests.

You may stop using the Service at any time.

Upon termination, the rights and licenses granted to you under these Terms will generally cease, except for provisions that by their nature should survive termination.

13. Third-Party Services

The Service may integrate with or provide access to third-party services, including:

Apple App Store;
Google Play;
Cloud hosting providers;
Analytics providers;
Advertising and attribution providers;
Payment processors;
Customer support platforms; and
Other third-party technology providers.

Third-party services are operated independently from Ludus Altus and may be subject to their own terms and privacy policies.

We are not responsible for the content, policies, availability, or practices of third-party services to the extent permitted by applicable law.

14. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis.

To the extent permitted by applicable law, Ludus Altus does not guarantee that:

The Service will always be available or uninterrupted;

The Service will be error-free or completely secure;

Defects or errors will always be corrected;

The Service will meet every individual user's requirements; or

Content or features will remain available for any particular period.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Ludus Altus, its affiliates, directors, officers, employees, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the Service.

To the extent permitted by applicable law, the total aggregate liability of Ludus Altus arising out of or relating to the Service or these Terms will not exceed the amount you paid to Ludus Altus for the Service during the six (6) months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

16. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Ludus Altus, its affiliates, directors, officers, employees, licensors, service providers, and business partners from claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from:

Your violation of these Terms;
Your misuse of the Service;
Your violation of applicable law; or
Your infringement or violation of any third-party rights.

This obligation will not apply to the extent that a claim results from the gross negligence, willful misconduct, or other conduct for which liability cannot legally be excluded by Ludus Altus.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws applicable to Ludus Altus Limited, except to the extent that mandatory consumer protection or other applicable laws provide otherwise.

Before initiating formal legal proceedings, you agree to contact Ludus Altus at [email protected] and provide a reasonable opportunity to resolve the matter informally.

Unless otherwise required by applicable law, disputes arising out of or relating to these Terms or the Service shall be submitted to a court of competent jurisdiction.

Nothing in this section limits any mandatory rights you may have to bring a claim in the courts or forums available under applicable law.

18. Changes to These Terms

We may revise these Terms from time to time to reflect changes in the Service, our business practices, technology, or applicable legal requirements.

When we make changes, we will update the Effective Date at the top of these Terms and publish the revised version on our website or through the Service.

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the updated Terms, to the extent permitted by applicable law.

If you do not agree with the revised Terms, you must discontinue your use of the Service.
